ARB PLANNING CRITERIA
The Covenants plainly state that the ARB Planning Criteria can only be changed by the Architectural Review Board. Please review the Special Board of Directors meeting on 8/20/2025. https://www.facebook.com/groups/swohoa The new ARB Planning Criteria voted on by the board was not recommended by the ARB Committee. Please review the ARB Committee meeting minutes for 9/8/2025 and previous minutes where the changes are not mentioned. https://www.sweetwateroak.org/home/ In the notice of changes there was nothing stating what the changes would be. The board not only voted to changed the ARB Planning Criteria but actually created new criteria and voted to add the criteria during the meeting. This appears to me, to directly violate our covenants and perhaps Florida State Statutes.
Following is a review of the Covenants concerning changes to the ARB Planning Criteria. In my opinion the board of directors have consistently ignored the Covenants and perhaps Florida State Statutes, when it comes to changing the ARB Planning Criteria.
I have discovered that the board of directors finally posted the current ARB Planning Criteria on the Clerk of Courts Official Records site on 09/08/2025. https://recording.seminoleclerk.org/DuProcessWebInquiry/ Click "I Agree" and on the right side of the next page please search Book 10892, Page 1787. This new planning criteria was never approved by the Association. Also, the Criteria according to our Covenants, could not go into effect until they were recorded.
