ASSESSMENT VOTING

 

Already sent in your proxy or electronic vote? If you change your mind about how you voted, you can change your vote any time up until a quorum at a meeting is achieved.Send an email to manager@sweetwateroaks.org and allboardmembers@sweetwateroaks.org saying that you are changing your proxy or electronic vote to whatever you decide to vote.

I believe that the Covenants are NOT being followed when voting an assessment increases. In Section 5. below, it says that the vote needs a 30 day notice. In Section 6. it says that another meeting may be called if a quorum of sixty percent of the members do not attend in person or by proxy. If there is not a quorum then a second meeting may be called "subject to the notification requirements set forth in Section 4 and 5". It does not say a meeting can be noticed prior to the meeting where a quorum is not achieved. When the assessments were increased in 2009 this is the procedure that was followed and there was 30 days between the meetings. When the assessments were increased in 2022 this procedure was not followed.  I believe by not following the covenants, the board of directors has left the association vulnerable to a law suit that could result in serious financial consequences for the association.

October 27, 2025 meeting. Quorum required to open the meeting 836 members present in person or by proxy.

October 28, 2025 meeting. Quorum required to open the meeting 465 members present in person or by proxy.

October 29, 2025 meeting. Quorum required to open the meeting 209 members present in person or by proxy.

October 30, 2025 meeting. Quorum required to open the meeting 105 members present in person or by proxy.

When a quorum is achieved the votes will be counted. To increase the budget 2/3s of the quorum must vote yes.

On October 30,2025, Seventy (70) members (5 percent of the membership) could make this decision and it will be binding on all members.
